What is the PPI Stomach Cancer & Kidney Damage Class Action Investigation about?

Shine Lawyers, in consultation with US firm Milberg Coleman Bryson Phillips Grossman (Milberg), is investigating a group of drugs called proton pump inhibitors (PPIs). These drugs are commonly used to reduce stomach acidity to treat conditions like reflux, heartburn, morning sickness, GORD, gastric ulcers and other digestive disorders and symptoms.

The PPI drugs under investigation are:

  • Nexium or Nexium 24HR (or other drugs containing esomeprazole)

  • Losec (or other drugs containing omeprazole)

  • Somac (or other drugs containing pantoprazole)

  • Pariet (or other drugs containing rabeprazole)

  • Zoton FasTabs (or other drugs containing lansoprazole)

It is alleged that there’s a link between the PPI drugs above and serious health issues, including:

  • stomach cancer (such as gastric adenocarcinomas or neuroendocrine gastric tumours); and

  • kidney damage (such as acute kidney injury, chronic kidney disorder, and kidney failure).

Can I join the PPI Stomach Cancer & Kidney Damage Class Action Investigation?

You may be eligible to join the class action investigation if you:

  • Nexium or Nexium 24HR (or other drugs containing esomeprazole)

  • Losec (or other drugs containing omeprazole)

  • Somac (or other drugs containing pantoprazole)

  • Pariet (or other drugs containing rabeprazole)

  • Zoton FasTabs (or other drugs containing lansoprazole)

Frequently Asked Questions

What is a Proton Pump Inhibitor used for?

Proton Pump Inhibitor drugs are commonly prescribed or used to reduce stomach acid for conditions such as heartburn/reflux, peptic ulcers, GORD, and Zollinger-Ellison syndrome.  Learn more here.

How do Proton Pump Inhibitors work?

Proton Pump Inhibitors work by stopping the cells that line the stomach (the proton pumps) from producing acid. This helps heal ulcers and reduces acid reflux symptoms. Learn more here.

Are Proton Pump Inhibitors safe?

Shine Lawyers are investigating this case on the basis that research across the globe has revealed that users of PPIs may be at an increased risk of developing stomach cancers (including gastric adenocarcinomas and gastric neuroendocrine tumours) and kidney injuries (including acute kidney injury, acute interstitial nephritis, chronic kidney failure and end-stage renal disease). However, please note that we cannot provide you with medical advice, and if you have concerns about your individual circumstances please discuss them with your doctor. Learn more here.

What about other H2 Blockers and other antacid drugs?

There are other types of drugs for the reduction of stomach acid, including H2-antagonist blockers (such as cimetidine) and antacids (which neutralise acids in the stomach and typically contain salts of aluminium, calcium, magnesium or sodium). These are not part of the PPI Stomach Cancer & Kidney Damage Class Action Investigation.

If I purchased Proton Pump Inhibitors over the counter, would I still be eligible for the class action?

Whether the Proton Pump Inhibitors were prescribed to you by a medical practitioner, or you purchased them yourself over the counter in a pharmacy, won’t impact your eligibility to join the class action investigation. Eligibility is detailed above.

What is a class action?

When Governments, large companies or institutions do the wrong thing and people are harmed or suffer loss as a result, an individual can have little to no means of bringing a legal claim.

Class actions are an important mechanism within Australia’s legal system that allow large groups of people to come together to pursue a claim collectively.

For a class action to take place, there are three criteria that need to be met:

  1. There must be 7 or more people that have claims against the same defendant; and

  2. The claims relate to the same or similar circumstances; and

  3. The claim must relate to at least one common issue of law or fact.

For more information about how class actions resolve, click here.

How long do class actions take to resolve?

It can take up to several years for a class action to resolve. The time taken from case commencement through to resolution and settlement administration depends on the particular case, and the nature of the claim.
